Minister of Immigration and Corrections Agus Andrianto has ordered the Inspectorate General of the Ministry of Imipas to trace all documents granting remission and parole to Moch Subchi Azal Tsani, alias Bechi, convicted in the sexual abuse case of a female student at Pondok Pesantren Majma'al Bahrain Shiddiqiyyah, Ploso, Jombang, East Java. The move follows reactions to Bechi's parole from civil society groups and women's protection organizations.
According to Agus, his office understands the concerns that have arisen, particularly from the victims. He said he had received input from Komnas Perempuan and the Ministry of Women's Empowerment and Child Protection (PPPA). The Inspectorate General team's review will cover every stage, from proposals by the prison's task implementation unit, the regional office, to the Directorate General of Corrections. "We will dig into whether the remissions granted so far complied with the rules or not," Agus said in a statement quoted from detikcom, Wednesday (23/9).
Agus stressed that granting rights to inmates must not come at the expense of victim protection. Although the mechanisms for remission and parole are regulated by law, he said the safety of victims must remain a primary consideration. He therefore ensured the evaluation would not be limited to Bechi's case but would also cover all proposals for conditional leave, parole, and pre-release leave submitted by the corrections ranks.
Agus also opened the door for the victim and her family to report if they feel threatened. He promised to revoke Bechi's parole if evidence of disturbing behavior is found. "If there is a report from the victim's family, threats or other things that disturb the victim or her family, do not hesitate to report to the nearest prison, I will revoke his parole," he said. The statement underscores that parole status does not erase the person's legal obligations and supervision.
During his parole, Bechi remains under the guidance and supervision of the Correctional Center (Bapas). He is required to comply with all applicable provisions, including the prohibition on actions that harm the victim. The head of Malang Class I Prison, Christo Victor Nixon Toar, explained that Bechi's sentence has been counted since 8 July 2022 and that he was moved between detention facilities before serving the remainder of his sentence in Malang.
"Parole does not mean the person is completely free. During the parole period, the person remains under guidance and supervision and must comply with applicable provisions." โ Minister of Immigration and Corrections Agus Andrianto
Bechi's case is a test for the Ministry of Imipas in balancing inmates' rights and victim protection. The public will watch closely whether the Inspectorate General team actually finds procedural violations or instead reinforces the legality of the parole. If irregularities are found, it is not impossible that remission policies for inmates in sexual violence cases will be evaluated more strictly. Conversely, if there is no violation, the government must still address the victim's concerns so that public trust in the corrections system is not eroded.
